“THOMAS BOTETOURT, Knt., of Essex, Upton, Norfolk and Great Bradley, Suffolk, son and heir apparent. He married before 1318 JOAN DE SOMERY, daughter of Roger de Somery, Knt., of Dudley (in Sedgley), Handsworth, King's Swinford Meer (in Forton), and Rowley Regis, Staffordshire, Bradfield, Berkshire, Ellesborough and North Crawley, Buckinghamshire, Weoley (in Northfield), Worcestershire, etc., by his wife, Agnes [see SOMERY 4 for her ancestry]. She was born about 1292 (aged 30 in 1322). They had one son, John, Knt. [2nd Lord Botetourt], and one daughter, Maud. In 1316 Bartholomew de Badlesmere, Thomas Botetourt, Thomas de Lovayn, and Robert de Wateville, Knts., and Master Richard de Clare, clerk, came into Chancery and acknowledged that they owed £1166 13s. 4d. to William de Roos, of Helmsley, Yorkshire, which debt was afterwards satisfied. In 1317 Thomas Botetourt and Thomas de Lovayn, of county Essex, Bartholomew de Badlesmere and William de Septvans, of county Kent, and others mainperned before the king to have Henry de Lekebum and Thomas Merle before the king in a month from Michaelmas to answer him and John de Brinchill. SIR THOMAS BOTETOURT died shortly before 28 July 1322. His widow, Joan, was co-heiress in 1322 to her brother, John de Somery, Lord Somery, by which she inherited the castle of Weoley (in Northfield), Worcestershire, together with the manors of Ellesborough, Hoggeston, and Newport Pagnell, Buckinghamshire, Gaynes (or Engeynes) (in Waresley), Huntingdonshire, Handsworth, Meer (in Porton), and West Bromwich, Staffordshire, Aston and Edgbaston, Warwickshire, and Churchill, Cradley (in Halesowen), Hagley, Hoggeston, and Northfield, Worcestershire. In 1327 John son of Richard de Sutton, lord of Malpas, Cheshire, owed £6000 to Joan, widow of Thomas Botetourt, Roger de Aylesbury, and Roger Hillary. The same year Walter le Halvere of Staunford acknowledged that he owed 25 marks to Joan Botetourt, lady of Weoley; to be levied, in default of payment, of his lands and chattels in Lincolnshire. In 1328 she had license to alienate the manor of Warley, Worcestershire to Halesowen Abbey for the support of three canons to act as chaplains, for the burning of six wax candles yearly, and, after her death, for the payment of one mark for her pittance, and for the distribution of 20s. to the poor on her anniversary day. In 1330 the king revoked his appointment by letters patent of three justices to hear and determine a trespass committed at Northfield, Worcestershire upon Joan Botetourt by brother Wolstan, Prior of Worcester, and others, because the letters were issued from chancery surreptitiously, contrary to the form of the statute of Northampton. The same year Joan, late the wife of Thomas Botetourt, Roger de Aylesbury, and Roger Hillary complained that John de Cherleton, John de Hynkeleye, and others broke their parks at Sedgley, Staffordshire, hunted therein, carried away deer, depastured and consumed the grass thereof with cattle, cut down trees, fished in the stews, and carried away the fish and trees with other goods found there and at Dudley and assaulted and imprisoned their servants. In 1331 John de Cherleton complained that Joan Botetourt, Geoffrey de Selleye, and others besieged his castle at Dudley, Staffordshire, broke the walls, carried away his goods, and assaulted his servants. In 1331 an assize was taken at Lichfield to determine if John de Cherleton, Knt., John de Hynkeleye, Knt., and others had unjustly disseised Joan, formerly wife of Thomas Botetourt, Roger de Aylesbury, and Roger Hillary, of three messuages, three virgates of land, 1,080 acres of wood, and the moiety of the castle of Dudley, Staffordshire. None of the defendants appeared; therefore it was considered that the said Joan, Roger, and Roger should recover seisin, and their damages were taxed at 1,000 marks. The same year Joan, widow of Thomas Botetourt, appeared by attorney against Walter de Dunclent, Edmund de Penne, and others for forcibly taking her goods and chattels at Swinford, Staffordshire to the value of 100s.; none of the defendants appeared, and the Sheriff was ordered to distrain those who had found bail, and arrest the others. In 1332 Joan, late the wife of Thomas Botetourt, Roger de Aylesbury, and Roger Hillary complained that John de Cherleton, Knt, and others committed trespasses in their park at Sedgley, Staffordshire. In 1332 Joan presented to the churches of Great Bradley, Suffolk and Clent, Worcestershire. In 1333 she complained that Richard de Lynsted of Shyrynton, Richard the younger his brother, Roger de Cave, and others assaulted her servants when collecting tolls at Newport Pagnell, Buckinghamshire, and compelled the merchants and others there to withdraw from the same. In 1334 she was granted free warren in her demesne lands in Linford, Buckinghamshire, Yenhall, Cambridgeshire, Bobbington and Handsworth, Staffordshire, Great Bradley, Suffolk, and Cradley (in Halesowen) and Old Swinford, Worcestershire. Joan died shortly before 12 Feb. 1338.
